Project: Strengthening Justice in Timor-Leste
Duration: Six Months
Duty Station: Dili, Timor-Leste
Background:
By mid-2002, seeking to respond to the post-independence situation, UNDP held discussions with the Ministry of Justice (MoJ) on the existing and future assistance of UNDP to the Timor-Leste Justice Sector, in order to move from a component-oriented approach to a more strategically oriented programme framework. Together with the Government, UNDP then started to the work of preparing for reformulation of the technical assistance provided to this sector, while at the same time continuing activities under the existing project. This included the fielding of two assessment missions; 1) one mission assessed the situation in the prison sector (October 2002), and 2) the other the situation in the judicial system, including the MoJ, the office of Public Prosecution, the office of the Public Defenders, and the Courts (November 2002). Both missions were fielded on the request of the Government of Timor-Leste and were joint efforts by UNDP/ MoJ.
Based on the findings of the assessment missions, the Ministry of Justice and UNDP fielded a joint mission to formulate a programme framework to assist the justice sector in Timor-Leste over the next 3 to 5 years period (February 2003). The programme document seeks to meet the needs as envisaged by the Ministry of Justice with respect to implementing the National Development Plan, which defines the objective of the justice system as, "developing and administering an effective, accessible justice system that is in conformity with positive values and East Timor's national cultural heritage". However, also the Government's Strategy Program, and the Ministry's Annual Action Plan for the next financial year, as well as priorities for the remaining period will be taken into account in the formulation exercise.
Justification
UNDP's Strengthening Justice in Timor-Leste programme seeks to develop in the East Timor justice system the organizational ability to use technology as a strategic tool to help the system achieve its objectives. The use of technology in Timorese justice institutions is currently at a basic level, and there is an exciting opportunity to establish integrated, standardized applications and systems aimed at improving the efficiency and effectiveness of the justice system.
Description
Under the coordination of the Chief Technical Advisor, the Chief Technology Officer will perform the critical visioning, management, and monitoring roles in developing and implementing a technology strategy for the justice system. The CTO will work closely with national counterparts with a view to transferring knowledge and skills to those people over a 2-year period.
Duties and Responsibilities:
a.. Establish a framework for IT work in the Ministry of Justice and the other justice institutions.
b.. Develop the overall vision for how IT will be used to best serve the justice system.
c.. Develop a strategic plan for the use and maintenance of IT in the justice system.
d.. Build an IT management, development and support team within the Ministry of Justice to serve the various institutions within the justice sector.
e.. Raise the profile and understanding of technology and how it can impact the efficiency and effectiveness of providing justice with an emphasis on managing expectations and influencing priorities of senior level personnel within the justice system.
f.. Direct the development of IT standards and policies, in coordination with similar efforts in other parts of government.
g.. Lead the development and implementation of a technology strategy focused on supporting institutional processes, collecting case data electronically and storing it centrally in a case management system, having always in mind the confidentiality issues.
h.. Participate in the setting up of the IT team that will support the entire Justice sector and of which he will be the main responsible;
a.. Measure the effectiveness of IT strategies within the justice system.
b.. Transfer knowledge and skills to the national counterpart.
c.. The incumbent will have to report and will be monitored by the Advisory Steering Committee
d.. Liaise with the focal points of the different institutions
Qualifications:
a.. Minimum 10 years experience managing technology groups
b.. Minimum 5 years experience being chief information officer or chief technology officer in an organization larger than 100 people
c.. A working technical proficiency to be able to provide support for or fulfill any one of the roles within the IT group, such as technical architect, business analyst, application developer, network administrator, database administrator, or end user support.
d.. Experienced in civil law countires
a.. English and Portuguese required.

The programme document seeks to meet the needs of the sector in line with the National Development Plan, Annual Action Plans and the Stability Programme as reflected in Timor-Leste Road Map for the Justice sector. The Chief Technical Advisor will play a vital role in the implementation of the project, liaising effectively with the heads of the four pillars of the sector to ensure that project objectives are met or, if not, that revision is made in a timely manner. The CTA will also ensure that regular donor briefings take place.
Description:
The Chief Technical Advisor (CTA) will work with the Senior Justice Advisor (SJA) in the Programme Coordination and Support Unit (PCSU), based in the Ministry of Justice, with designated counterparts, in order to ensure the implementation of the activities in accordance with the detailed outline of project document agreed upon between UNDP and the key justice sector institutions. The CTA will coordinate the work of the four Project Implementation Units (PIU) and their staff (Chief Technology Officer, Senior Technical Advisor, Judge Advisor and Prosecutor Advisor). The CTA will be responsible for assisting in the preparation of work plans in conjunction with national counterparts and coordinate reporting against these work plans, providing substantive support to the organization of all project activities, liaising with all counterparts, preparing and contributing to an ongoing programme formulation exercise, monitoring of project activities, reporting to UNDP's management on progress and results achieved by the project activities.
Duties:
a) Project Management: The CTA will advise and assist the National Focal Points (NFPs) and the Council of Coordination (CoC), comprising of MoJ, Prosecutor General and President of the Superior Council of the Magistracy on all aspects related to the following responsibilities:
Day-to-day operational management of the project. In close collaboration with the NPD, the CTA will plan, initiate, facilitate and manage project activities and measure performance and report on project results and outcomes to UNDP programme officer and the CoC;
Build national capacity for project implementation/ management / monitoring,
Preparation and updating of work plans and monitoring their implementation, management of budgets and resource allocation, workload management, performance assessment and definition of indicators for the different departments;
The preparation of Terms of Reference and design for such events as training (curricula, courses, schedules), study tours, conferences and workshops, and to advise the UNDP on the joint approval and sign-off of these documents;
Preparation of Terms of Reference for recruitment of international and national consultants and advisors, and advise the government and UNDP on joint identification, selection and approval of such advisors and consultants;
Provide information and guidance to the heads of institutions and to consultants working for the project
Supervision, coordination and evaluation of the work of advisors and all the project administrative support staff;
Reviewing and monitoring the overall management, performance and progress of the project by preparing indicators to monitor progress on the project document.
Report to management on progress and achievement of results;
Maintaining a proper filing and documentation system related to the management of the project and to train counterpart staff in this area;
Assist promoting dialogue and good practice among different stakeholders;
Coordinate and prepare the conduct of the Council of Coordination meetings, preparation of the minutes of these meetings and following up on the implementation of decisions taken;
Be responsible for selecting and bringing international lessons learnt to help achieve the outputs of the project and facilitating the use of global knowledge networks in the field. Assist the NFPs in sharing project results including through reviewing project publications, and by taking responsibility for knowledge networking with national agencies and UNDP's global community.
Represent the project before UNDP, and provide other advice as needed to UNDP concerning the evolution and role of the Ministry of Justice, the public defenders, the Judiciary and the Office of the General Prosecutor
b) Coordination with Local Justice Institutions
To represent the project before the national authorities;
Provide advice and support as may be required by the Ministry of Justice, the Superior Council of Magistracy and the Office of the General Prosecutor, as is to be expected in a dynamic process of change.
c) Donor Coordination and information
Brief interested donors, or foreign missions on the activities of the project.
Assist the CoC in providing information in open meetings on a biannual basis to the civil society, NGOs, the church
Advise the CoC in briefings to donors.
Qualifications and Experience:
University degree in Law
University degree in Management/Institutional change;
Experience with working procedures of justice sector institutions in with in Civil Law Countries;
A minimum of seven years of extensive working experience in the area of design, management, capacity building and implementation of legal reform processes and working in a legal profession;
Human Rights expertise with regard to the justice sector
Good command of written and spoken English. Knowledge of Portuguese is required. Knowledge of Tetum or willingness to learn is an asset;
Team building skills and proven ability to work with diverse groups and to facilitate dialogue;
Knowledge and command of the role of information technology, preferably in the field of Justice
Excellent management and communication skills
Experience in UNDP budget and financial management of projects, is an asset.
Sound judgment, flexibility and adaptability, excellent communication skills, cultural sensitivity
Knowledge of Timor-Leste context and mentalities or similar experiences would be recommended
Timeframe:
The Chief Technical Advisor will commence his or her duties as soon as possible. An initial 6 months probationary contract will be converted to an additional one year contract renewable every year up to 3 years.

Title: Senior Justice Advisor

The Senior Justice Reform Advisor will play a vital role in this programme, overseeing and providing substantial advise on the effectiveness of the implementation of the programme.
Description:
The part-time Senior Justice Advisor will support the Ministry of Justice of Timor Leste's strategic management with regard to and overall quality of the Capacity Development within the Support to the Judicial Sector programme. The scheduling of routine and as-required inputs from this international advisor will ensure overall integrity of the programme design and implementation, the cost-effective deployment of UNDP and other donor inputs, and the casting of realistic and workable implementation strategies and plans. The SJA will assist in building institutional capability to undertake necessary reform. The timing and specific terms of reference for each mission will be developed in close coordination with the Council of Coordination (CoC) and UNDP. The Senior Justice Advisor will work closely with the heads of the four pillars of the Justice sector and UNDP. Support will be provided from a combination of on-site consultation and home-office based analysis. The SJA can be an individual or a firm on a retainer contract, or a plurality of individuals on separate short-term contracts, depending on the choice of UNDP and the CoC.
Duties:
Advise the programme regarding design and implementation approaches to ensure that in institutional capabilities are built so that the objectives and outputs specified in the programme document are achieved;
Advice the CoC as well as the government management, the CTA, UNDP, the Prosecutor General, the President of the Court of Appeals;
Advise the programme on substantive aspects of programme design, management and implementation strategy, covering such aspects as scope, priorities, performance measures, coordination, implementation principles and related areas, always bearing in mind the need to ensure ownership;
Provide the programme and UNDP with independent assessments of the overall progress and achievement of results, and to recommend adjustments to strategies and plans, as appropriate, to ensure ongoing achievement of results;
Advise the programme on the preparation of terms of reference and design for recruitment of international and other consultants and experts;
Provide other such substantial advice and support as may be required by UNDP and the programme as is to be expected in a dynamic process of sustainable change;
Function as a resource person for the CTA, UNDP and the CoC;
Assist in providing information and guidance to consultants working for the programme and to brief interested donors, or foreign missions on the activities of the programme;
Assist CoC in providing information to the public;
Other tasks as required;
Specific Tasks
Assist institutionalizing a policy development and planning unit in the MoJ;
Assist establishing a working group led by MoJ and comprising representatives of key justice institutions to draft a policy document for the justice sector;
Advice the CoC, comprising of MoJ, Prosecutor General, President of the Superior Council of Judiciary and the Coordinator of the Public Defenders;
Oversee and assist the timely preparation of Annual Action Plans for 2004 and 2005 to reflect priorities of a 3 - 5 year strategic action plan for the justice sector;
Advise the drafting team in the Ministry of Justice on legislative drafting issues related to the justice sector.
Qualifications and Experience:
Substantive (15-20 years) experience in Judicial system reform in civil law countries with a preference for experience in Lusophone countries;
Substantive experience in law drafting in the area of justice in a civil law country;
Substantive experience in managing institutional change in post conflict situations;
Substantive experience in programme management, monitoring and evaluation a strong advantage;
Substantive experience of human rights in the Justice Sector
Substantive experience in strategic, corporate and operational planning;
Substantive experience in capacity building and institutional strengthening;
Substantive experience in change, management, development and process facilitation;
Proven ability to communicate with diverse groups and facilitate inter-institutional communication and coordination;
Good command of written and spoken English. Knowledge of Portuguese is required;
